J.B. Heaton

"Heaton is thus imminently qualified as an expert, and the Court will assign the appropriate weight to Heaton’s testimony." - Spence v. American Airlines, Inc., 23-cv-00552-O (N.D. Tex. Jan. 10, 2025).

My personal mission is to uncover the truth and effectively rebut falsehoods in high-stakes litigation concerning economics and finance, including causation and damages models and their assessment.

I hold a Ph.D. in finance and an M.B.A. with a concentration in analytical finance from the University of Chicago Booth School of Business, as well as a J.D. from the University of Chicago Law School. My academic background includes extensive coursework in corporate finance, asset valuation, econometric modeling, and litigation risk analysis, all of which are central in assessing litigation uncertainties.  Academics and numerous courts have cited my research on finance and its application to litigation issues. See, for example, Teleglobe USA, Inc. v. BCE Inc. (In re Teleglobe Communs. Corp.), 392 B.R. 561, 602 (Bankr. D. Del. 2008) (Walrath, J.); In re Citx Corp., 448 F.3d 672 (3d Cir. 2006); In re Parmalat Sec. Litig., 501 F. Supp. 2d 560 (S.D.N.Y. 2007); Official Comm. of Unsecured Creditors of Verestar, Inc. v. Am. Tower Corp. (In re Verestar, Inc.), 343 B.R. 444 (S.D.N.Y. 2006); OHC Liquidation Trust v. Credit Suisse First Boston (In re Oakwood Homes Corp.), 340 B.R. 510 Bankr. D. Del. 2006); In re AllstateCorp. Sec. Litig., 966 F.3d 595 (7th Cir. 2020); In re Petrobras Sec.,862 F.3d 250 (2d Cir. 2017); Pirnik v. Fiat ChryslerAutomobiles, N.V., 327 F.R.D. 38 (S.D.N.Y. 2018).

I have over thirty-five years of experience analyzing and estimating litigation risk. As a litigation partner at Bartlit Beck LLP (2005-2017), I spent most of my time working on behalf of hedge funds and other institutional investors in prosecuting and assessing causation and damages litigation. I have continued this work since acting as a consultant and (occasionally) as an expert witness on behalf of hedge funds, insurance companies, litigants, and their legal teams, focusing on the role of uncertainty in litigation.

My current consulting rates range from $600 per hour for smaller matters to $1,200 per hour for larger matters, including those where I have been retained by large consulting firms for consulting or expert testimony.
